When negotiation is unsuccessful one of the parties will usually file a lawsuit.  Our San Diego Courts are quite backlogged and all cases require a “Settlement Conference” with the Judge prior to going to trial.  This may or may not occur, however the next step is often business mediation.  Business mediation is a private, confidential process which keeps your business and financial information out of the public record.

An experienced mediator is selected by the two parties.  The mediator works with the parties to help them to understand the strengths and weaknesses of their case and potential paths to resolve the dispute.  If the mediation is successful a settlement agreement is executed and the matter is concluded.  This is perhaps the second most common strategy to successfully resolve a business dispute in San Diego.

The mediator may be able to resolve some but not all of the issues at hand.  That’s actually quite helpful.  The settlement agreement from mediation resolves those portions of the matter and the remaining issue(s) must be taken to arbitration or trial.  Most business contracts specify arbitration as an alternative to trial in a Court of Law.

Arbitration is a lot like a trial, however, it is compressed into a matter of a few weeks instead of months or more than a year.  The parties select an experienced arbitrator who has expertise in both the law and the subject matter of the dispute.  The arbitrator establishes an efficient process to marshall evidence and collect testimony, usually in a matter of days.  Most business disputes are resolved through “binding arbitration.”  In binding arbitration the ruling of the arbitrator is final and cannot be appealed.
