Following negotiation, there are two primary alternative dispute resolution alternatives: mediation and arbitration. Mediation, much like the settlement conference associated with the Court is the next best alternative to resolve a business dispute in a reasonable and timely manner. Mediation is a private, confidential venue where a highly experienced 3rd party works between the disputing parties to help them understand the strengths and weaknesses of their positions, find common ground and ultimately reach a reasonable settlement. Arbitration is often the next step established in the original contract. Arbitration will bring the case to a close in a matter of days or weeks but the decision of the arbiter is final and can almost never be appealed.
