Hidden Construction Defects and Roof Leaks Defective Solar Install

Are you a San Diego homeowner involved in a dispute with a solar company or installation team?  Do you have hidden construction defects and roof leaks resulting from the installation of solar at your home?  Solar power continues to rapidly grow throughout San Diego and southern California.  The advent of leasing has increased the San Diego solar market by more than 60%.  What happens when solar panels are defective or roof leaks arise from poor installation or workmanship?  Where can a homeowner turn when solar power companies use deceptive marketing tactics and unfair competition and advertising in order to make a sale?

Our firm takes a unique approach to disputes and litigation designed to resolve the dispute in the shortest possible time frame and in a cost-effective manner.  We understand the nature of disputes with contractors and installation crews who may have caused damage to your home.  How are these cases resolved?

The vast majority of business and contractor related disputes in San Diego are resolved through effective leveraged negotiation.  The Watkins Firm attorneys take action to gain the other party’s attention while driving home the financial damages associated with the dispute and the power of the law as it relates to these transactions in California.  When a serious disagreement of principle regarding hidden construction defects and roof leaks resulting from the installation of solar arises in San Diego, mediation and arbitration provide a sound alternative to litigation in a Court of Law.  When necessary we will take your case before a San Diego or California Court to pursue your objectives and goals.  If there are hidden construction defects and roof leaks associated with your solar installation we can help.

Dan Watkins Founding Partner of the Watkins FirmPro-Tip: “There’s two types of defects. There’s the obvious and there there’s the hidden patent and latent defects. You’re responsible for both, but the standard of care is different between the two. If it’s an obvious defect, you’re more likely going to be in trouble if you don’t disclose it. But if it’s so obvious, then the other side can’t say they didn’t know about it. And if it’s hidden, then how hidden is it and should you have known? And is it hidden to such an extent that the other side, the buyer, let’s say, couldn’t have known about it.

What is the level of awareness required of a seller?  A buyer?  A homeowner facing damage to the roof and resulting leaks due to poor installation? In residential real estate law, there’s something called a transfer disclosure statement or TDS. And that is governed out of civil code section 1100. And that talks about what the actual legal requirement is for disclosure. And this form has grown from one page to six pages. And you have to be honest on that. So when I get real estate defect case today, I’ll go right to that document because somewhere in there, if the seller’s a bad person, they lied on the TDS. And that’s where you have a problem because it’s hard to sell a house with a big defect and you don’t want it, and you can’t afford the house anymore. So you get tempted to just kind of skimp on your disclosures, to hide it and pass it on.

And you just hope nobody realizes it, or they just let it go. So where’s that fine line between you knew about this versus, okay, maybe you really didn’t know about this, but we have a problem?  That’s when you reach out to us at the Watkins Firm for a free consult.” – Dan Watkins, Founding Partner
